1. Acceptance of Terms

Welcome to Real Life Subtitles. By downloading, installing, accessing, or using our iOS application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you ("User," "you," or "your") and Real Life Subtitles ("we," "us," or "our").

2. Eligibility

You must be at least 13 years old to use the App. If you are between 13 and 18 years old, you represent that you have your parent's or legal guardian's permission to use the App. By using the App, you represent and warrant that you meet these eligibility requirements.

3. License and Restrictions

3.1 License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on iOS devices that you own or control, solely for your personal, non-commercial use.

3.2 Restrictions

You agree NOT to:

• Modify, reverse engineer, decompile, or disassemble the App
• Copy, reproduce, distribute, or create derivative works of the App
• Remove, alter, or obscure any copyright, trademark, or other proprietary notices
• Use the App for any unlawful purpose or in violation of these Terms
• Attempt to gain unauthorized access to any part of the App or related systems
• Use the App to harass, abuse, or harm another person
• Use the App in a way that could damage, disable, or impair the service
• Rent, lease, lend, sell, redistribute, or sublicense the App
• Use the App to violate any applicable laws or regulations

4. Subscription Plans and Payments

4.1 Free Tier

The App offers a free tier with limited features and daily usage quotas. Free tier access may be modified or discontinued at any time without notice.

4.2 Pro Subscriptions

Pro subscriptions unlock additional features including:

• Unlimited caption sessions
• Live translation capabilities
• Advanced styling options
• Session history and auto-save
• Professional export formats (SRT, VTT)
• Priority customer support

4.3 Subscription Types

• Pro Weekly: $4.99 per week, billed weekly. Includes 7-day free trial for new subscribers.
• Pro Lifetime: $49.99 one-time payment for lifetime access to Pro features.

4.4 Payment and Billing

• All payments are processed through Apple's App Store
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
• Your Apple ID will be charged upon confirmation of purchase
• You can manage subscriptions and turn off auto-renewal in your iOS Settings
• Prices are in U.S. dollars and may vary by region
• Prices are subject to change with notice

4.5 Free Trials

• Pro Weekly includes a 7-day free trial for new subscribers
• You can cancel during the trial period to avoid being charged
• If you don't cancel, you'll be charged the subscription fee at the end of the trial
• Only one free trial per Apple ID

4.6 Cancellation

• You can cancel Pro Weekly subscriptions at any time through iOS Settings
• Cancellation takes effect at the end of the current billing period
• No refunds for partial subscription periods
• Pro Lifetime is a one-time purchase and is non-refundable except as required by law

4.7 Refunds

All sales are final. Refund requests must be made through Apple's App Store according to Apple's refund policy. We do not have the ability to issue refunds directly.

5. User Content

5.1 Your Transcriptions

You retain all rights to the transcriptions and content you create using the App. We do not claim ownership of your transcriptions, captions, or any content you generate.

5.2 Storage and Backup

• All transcriptions are stored locally on your device
• You are responsible for backing up your data
• We are not responsible for any loss of data
• Pro users' session history is stored on-device and may be backed up to iCloud if enabled

5.3 Prohibited Content

You agree not to use the App to transcribe or create content that:

• Is illegal, harmful, threatening, abusive, or harassing
• Violates intellectual property rights
• Contains malware or harmful code
• Is pornographic, obscene, or offensive
• Violates any applicable laws or regulations

6. Intellectual Property

6.1 Our Rights

The App, including all content, features, functionality, and design, is owned by Real Life Subtitles and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

6.2 Trademarks

"Real Life Subtitles" and our logo are trademarks of Real Life Subtitles. You may not use these marks without our prior written permission.

6.3 Feedback

If you provide feedback, suggestions, or ideas about the App, you grant us the right to use such feedback without compensation or attribution.

7. Third-Party Services

7.1 Apple Services

The App uses Apple's services including Speech Recognition, App Store, and iCloud. Your use of these services is subject to Apple's terms and conditions.

7.2 Translation Service

Live Translation features use OpenAI's API. By using translation, you agree to OpenAI's terms of service and privacy policy. Translation quality and availability are not guaranteed.

7.3 Third-Party Links

The App may contain links to third-party websites or services. We are not responsible for the content, privacy policies, or practices of third-party sites.

8. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability and fitness for a particular purpose
• Warranties regarding accuracy, reliability, or quality of transcriptions
• Warranties that the App will be uninterrupted, secure, or error-free
• Warranties regarding translation accuracy or quality

You acknowledge that speech recognition technology is not 100% accurate and transcriptions may contain errors. Translation quality varies and should not be relied upon for critical communications.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL REAL LIFE SUBTITLES BE LIABLE FOR ANY:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or use
• Damages resulting from transcription or translation errors
• Damages resulting from unauthorized access to your device or data
• Damages resulting from interruption or cessation of service

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $50, WHICHEVER IS LESS.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so these limitations may not apply to you.

10. Indemnification

You agree to indemnify, defend, and hold harmless Real Life Subtitles, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including legal fees) arising from:

• Your use or misuse of the App
• Your violation of these Terms
• Your violation of any rights of another person or entity
• Content you create using the App

11. Privacy

Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use, and protect your information. By using the App, you agree to our Privacy Policy.

12. Updates and Changes

12.1 App Updates

• We may release updates, bug fixes, and new features
• Some updates may be required to continue using the App
• You are responsible for downloading and installing updates
• We may discontinue support for older iOS versions

12.2 Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

• Posting the updated Terms in the App
• Updating the "Last Updated" date
• Providing in-app notification for significant changes

Your continued use after changes take effect constitutes acceptance of the new Terms.

12.3 Changes to Service

We reserve the right to:

• Modify, suspend, or discontinue any part of the App
• Change pricing with notice
• Modify or remove features
• Change subscription plans

13. Termination

13.1 By You

You may stop using the App at any time by:

• Canceling your subscription (if applicable)
• Uninstalling the App from your device

13.2 By Us

We may terminate or suspend your access immediately, without notice, if:

• You violate these Terms
• You engage in fraudulent activity
• We are required to do so by law
• We discontinue the App

13.3 Effect of Termination

• Your license to use the App immediately ends
• You must stop using the App and delete it from your devices
• Data stored on your device remains your responsibility
• Provisions that should survive termination will continue to apply

14. Dispute Resolution

14.1 Informal Resolution

Before filing a claim, please contact us at support@reallifesubtitles.com to attempt to resolve the dispute informally.

14.2 Governing Law

These Terms are governed by the laws of the United States and the state in which we operate, without regard to conflict of law provisions.

14.3 Arbitration

Any disputes arising from these Terms or the App will be resolved through binding arbitration, except where prohibited by law. You waive your right to participate in class actions.

15. General Provisions

15.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Real Life Subtitles regarding the App.

15.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.

15.3 Waiver

Our failure to enforce any right or provision does not constitute a waiver of that right or provision.

15.4 Assignment

You may not assign or transfer these Terms. We may assign our rights and obligations without restriction.

15.5 No Agency

No agency, partnership, joint venture, or employment relationship is created by these Terms.

15.6 Force Majeure

We are not liable for delays or failures due to circumstances beyond our reasonable control.

16. Accessibility

We are committed to making the App accessible to all users. If you encounter accessibility issues, please contact us at support@reallifesubtitles.com.

17. Export Compliance

You agree to comply with all applicable export and import laws and regulations. You may not use or export the App in violation of U.S. export laws or regulations.

19. Acknowledgment

BY USING REAL LIFE SUBTITLES, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS OF SERVICE.
